   to give an opinion about 14.3, you need to comply with section 14.1 states " No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws."

   First of all, this interview didn't even address the question in the title "Can Trump lose 2024 from 'ballot ban'?". I have to believe Ari was just playing "devil's advocate" here, because surely he KNOWS Section 3 does NOT in any way say that one must be CONVICTED of Insurrection. There is nothing there about "due process" of PROVING Trump engaged in insurrection through a criminal trial. Ari also knows that different court procedings require different levels of evidence, and how that evidence is presented to the court. Ari knows that criminal trials are VERY different (in terms of evidence) than civil trials. Ari also knows this was a CIVIL trial…. and that Trump WAS represented there by his lawyers, even though he himself didn't find it important enough to show up for (which he had every right to do). So, either Ari has forgotten everything he ever learned in Law School, or he's just playing devil's advocate here and voicing the concerns of MAGA, or those that just don't understand what's happening here. I think his guest did a great job answering those concerns.

    The rule of law. Innocent until proven guilty in a court of law. I am not a Republican and I think he did encite insuraction he needs to be found guilty and spend the rest of his life in prison. We can't ignore the law. Until then he shouldn't be removed from any states to run foe any office

    I don't think it will occur to Trump supporters that once he's in office he will no longer need the Supreme Court of the United States nor will he need a government the size of our government to represent the people because the only representation he needs is a small group of loyalist around him. We will not need all the senators and Congressman. These politicians are total idiots for standing with him. They better get ready to say "do you want fries with that".

    There is a practical issue here too. People that want to run for office often get in at the last moment and it takes a long time to go through subpoenas, witnesses, etc. and as the Secretary said Trump decided not to attend the hearing that ran 5 days in CO so he had a lot of opportunity too present his case. He chose not to in a personal way. His clear conscious action over the years of ignoring the Rule of Law is something the American People are very aware. Officer, I need witnesses, subpoenas etc. before you can issue me that ticket. Think of the cumbersome system those type of proceedures would require. If it looks like an insurrection, sounds like an insurrection and smells like an insurrection I expect we Americans can see that it was an insurrection.

    Those charged from Jan 6th were charged with obstructing an official proceeding. One of the questions the Supreme Court will have to decide is if the President was included in the offices listed. Sec 3 stated "No one shall be a Senator, a Representative in Congress or an elector of President and Vice President. They did not specify the office of President.
    Jena Griswold by removing Trump from the ballot is obstructing an official procedure. While the SC will have to determine if the President is included in those offices that are disqualified from holding office, the Colorado Secretary of State clearly is one of those covered by Sec 3. Since obstructing an official proceeding is now being defined as insurrection, then Jena should be removed from office under Sec 3

    Ari…. let Texas ban whomever they want. We have courts to settle these issues. We, the people, can appeal any Texas ban if we feel it is unjustified. Chaos? NO. Heck, NO!! It is the legal approach. It is why we have courts of law. Stop worrying about what Texas may or may not do. The Supreme Court will make a ruling. We will live by it. "This is the way!"     Jan 6 was a riot where majority of the people in the capital were not violent as some even said they were let in. Some however violently took the place. But nevertheless it was a riot. Now rewind to 2016 when democrat supporters rioted because their candidate lost the election resulting in damage of property throughout American cities and even assaults on innocent people. Both are inexcusable and the only difference one happened in a government building and the other in major American cities.

    Your confused…Trumps assertion that he would pardon the J6 convicted participants,is evidence alone, in light of Seditious Insurrection Convictions by some of them, is evidence of giving aid to convicted insurrectionists… meaning he is D I S Q U A L I F I E D…END OF STORY.

    Ari and Jena are BOTH wrong as well as the dessenting justices to Colorado law. Ari and Jena are both lawyers who just don't have the right perspective on the law. A Constitutional amendment whenever it was enacted is valid, and it says what it says without Ari trying to add things not there. On this Ari is just plain WRONG

    This why people need to stop calling the riot of January 6, 2021 an insurrection – and trying to link it to Section 3 of the 14th amendment

    Judge J. Michael Luttig cleared this argument up on November 3 2023 and Jena is wrong that it goes to the Supreme Court when by the final sentence of Section 3 of the 14th amendment it does not – it goes before Congress

    I am not a Trump supporter, but I am telling you that legally there was no insurrection January 6, 2021 as it relates to proving Section 3 of the 14th amendment, and that Trump was "engaged in insurrection" under 18 USC 2383 by inciting a riot on that date to cover his scheme to insert fake elector certificates changes the electoral votes to him.

    Judge J. Michael Luttig made this clear on November 3, 2023 in an interview on "Deadline Whitehouse" on MSNBC to Nicole Wallace before she left the show to become an adoptive mom to an infant. Paste that onto the end of the youtube url at watch?v= and further in that video he explains how the Supreme Court could through that error rule on the Colorado Supreme Court ruling that nullifies it.

    Everyone wants to persistently call the January 6, 2021 riot an insurrection by Trump, when it was not because legally for Trump he was instead in "rebellion to Article II Section I Clause I which activates Section 3 of the 14th amendment of which the riot was only a component of the scheme.

    This is a serious distinction the Supreme Court could use to claim under the constitution a violation of Section 3 of the 14th amendment was not met nor proven. Under 18 USC 2383 yes there Trump was engaged in insurrection by inciting the riot, but the Supreme Court could turn a index eye to that reality as also barring him from office regardless with no oath or prior office requirement

    Through comity of the courts and the Supremacy Clause courts can use any definition in the law in any relevant process it relates to. The Colorado District Court went through 18 USC 2383 of incitement to reach engaged in insurrection to apply to Section 3 of the 14th amendment. While valid because the incitement was stated as his cause to continue his svhemeyo stay in power, still it was not how to prove a Section 3 of the 14th amendment violation, though in this case it was harmless efror

    What I am saying is people cannot just "there was an insurrection" and make it legally true.

    There was no insurrection against the Constitution of the United States, Trump is saving that for day one of his return to power where he says he wl declare the Insurrection Act in effect and martial law then takes effect. Trump says then he would suspend the Constitution. That is the insurrection against the Constitution of the United States.

    Trump right now this moment was in "rebellion" to the Constitution of the United States at Article II Section I Clause I which activates Section 3 of the 14th amendment but no one argued that legally, specifically, clearly.

    In law words and procedure matters, and it sad but true people and the media people need to get law degrees before preaching, reporting and trying to predict what the SCOTUS might do

    Allow me to respectfully shut you down Ari. It doesn't just say "engaged in an insurrection" it also says "or given aid or comfort to the enemies thereof." HELLO? Have you seen him promoting the insurrectionists music, saying they are fine people and promising to pardon them if re-elected? Did you not see him tell them he loves them as they were holding our capital hostage? Are you going to say that he has not aided and comforted the insurrectionists? Your argument sounds good but it falls flat when it's held up to basic common sense.

    The removal of a name, from a ballot, by a state, is an administrative action, not a criminal action. No trial is needed to determine guilt or innocence. If you have a job there are rules you must abide by. If you do not abide by those rules your name is removed from the payroll. The president has rules to abide by also, some of them contained in the 14th amendment. Trump's name was removed from the ballot but you still have the right to vote for him by adding his name to the ballot. Whether that vote will count or not will be decided at a later date.
