This could have been a legal case, and the outcome of that case would have determined the fate of Nata and Trump. It might also have impacted the 2024 election cycle, and who would have been the Republican nominee.
Now, we’re in a position where the legal case almost doesn’t matter. The power of BS and marketing persuasion is so great that Trump could be convicted and be no less worse for wear. He could be no worse off in any measure.
He won’t go to jail.
He can still be president.
He’s still rich.
He’s still getting the attention he craves.
He can continue to change the world through his speech.
As bad as those outcomes might be, it could be even worse:
He could fund-raise more effectively.
His base will be hardened even further.
The cold civil war could see flashpoints around this case. An already polarized America could become even more polarized around this case, and some people might even act out.
This could catapult Trump to the White House Retaliation Desk.
And this: Our sense of what is permissible under law could be further undermined.
Those downside consequences have less to do with the legal case. They stem from the media’s handling of this story. I believe all of this will happen if we fail to do one thing: Challenge BS and the ones who deliver it.
This is a minute in American history, and the media’s performance will determine our outcome. The last time the media had such awesome responsibility was during the Montgomery bus boycott.
You could argue that media’s response to the Watergate plot had similar importance, but you’d be wrong. You see, during Watergate facts mattered. There was [more] rationality and there was no Fox News pumping out lies. Moreover, politicians had more respect for national security, unlike Lindsay Graham and Kevin McCarthy.
The burden on and need for the media to fend off mendacity, lies, and BS is far greater now, and the consequences are much weightier. It is a momentous time to be in the media. Full of importance.
The media has failed plenty of times.
It failed to educate us about the lies that led to the Iraq war.
It abetted the Trump 2016 campaign for commercial gain.
It lied about the Black power movement, Malcolm X and the effort to build Black self-sufficiency.
It helped the Right to persecute Hillary.
It fed us polls daily trying to convince us that Sanders, a Socialist, could be elected president.
It largely ignores the left wing of the Democratic party, and the plight of the poor.
I could do this all day. All day!
But here we are.
Every BS legal opinion about the Trump documents case needs to be challenged – on air. That means: No asymmetrical interviews. If a lying, greasy, oily lawyer is interviewed and stridently tries to snow us into disbelieving our lying eyes, a real lawyer should also be on-set with the pin to pop the stank-balloon.
Andrew, Neal, Barbara, Katie, Ari, Joyce all of you (and the rest)…on-call. Your foxhole is the studio and you’re fighting for your country – with facts as ordinance.
Read: This case should be won in the courtroom and in the media. No uncontested lies allowed. Again: If it’s lost in the media, the courtroom case doesn’t matter.
Ya’ll ain’t just in the News Business. You’re in the America Business.

It's not a dark day. Democrats really should celebrate this day. Nixon was left off free. Bush was left off free after starting a war of aggression with thousands Americans killed. Do you know why Keitel, Ribbentrop and Jodl were executed after the Nuremberg trials, prosecuted by the United States? Conspiracy against peace and planing, starting and continuation of a war of aggression. That the US does not hold its highest leaders to a higher standard is a real problem which will only get worse if you don't start to enforce accountability.
